What Are the PBT Chemicals Under TSCA Section 6(h)?

The 2016 Frank R. Lautenberg Chemical Safety for the 21st Century Act includes a provision under Section 6(h) of TSCA that requires the U.S. Environmental Protection Agency (EPA) to take expedited action on certain Persistent, Bioaccumulative, and Toxic (PBT) chemicals to address risks and reduce exposure to the extent practicable. In 2016, the EPA identified five PBT chemicals requiring expedited action and proposed a rule in 2019. Finally, on January 6, 2021, the EPA issued the final rule regarding these chemicals.


Under the Toxic Substances Control Act (TSCA), the EPA has the authority to regulate persistent, bioaccumulative, and toxic (PBT) chemicals to protect human health and the environment. These substances can accumulate in the environment over time and may pose potential risks to exposed populations, including the general population, consumers, commercial users, and vulnerable subgroups such as workers, subsistence fishers, tribal communities, and children.


The following are the five PBT chemicals on which the U.S. Environmental Protection Agency (EPA) has taken expedited action:

1. Decabromodiphenyl Ether (DecaBDE) (CAS 1163-19-5)

2. Phenol, Isopropylated Phosphate (3:1) or PIP 3:1 (CAS 68937-41-7)

3. 2,4,6-tris(tert-butyl)phenol (2,4,6 TTBP) (CAS 732-26-3)

4. Hexachlorobutadiene (HCBD) (CAS 87-68-3)

5. Pentachlorothiophenol (PCTP) (CAS 133-49-3)
